The seller undertakes to keep product availability information up to date; however, a product may turn out to be unavailable after the order has been submitted, for logistical, technical, supply or catalogue update reasons.
In the event of total or partial unavailability of the product ordered, the seller will inform the user and may offer, at the user's choice:
-
replacement with another equivalent product or one of similar value;
-
waiting for restocking, where possible;
-
a full or partial refund of the order.
Article 6
Shipping, delivery and logistics model
Products purchased through the site are shipped to the address provided by the user when placing the order.
The seller also operates through an online sales logistics model with direct shipping from suppliers, logistics partners or warehouses located also outside the European Union, including China. The user acknowledges that, due to this organisational model, some products may be shipped directly from foreign warehouses or suppliers.
The processing and delivery times indicated on the site are estimates and may vary depending on product availability, the country of destination, the time of year, courier operations, customs procedures and any events beyond the seller's control.
Unless otherwise indicated on the product page or on the checkout page, orders are normally processed within a few business days. Estimated delivery times may vary depending on the destination and on the operational workload of the seller and the couriers.
Where available, the seller provides a tracking code that allows the user to monitor the status of the shipment.
The user is required to provide a correct, complete and attended delivery address. The seller is not responsible for delays, failed deliveries or additional costs resulting from incorrect, incomplete or outdated data provided by the user.
Should the tracking show the parcel as delivered but the user state that they have not received it, the user must promptly contact the seller, who may carry out the appropriate checks with the carrier within the limits of the information available.
Article 7
User obligations
The user undertakes to use the site in accordance with the law, these Terms and Conditions and the principles of fairness and good faith.
The user undertakes to provide truthful, complete and up-to-date personal data, contact details, shipping addresses and payment information.
The user is responsible for any errors in the data entered when placing the order and undertakes to promptly inform the seller of any necessary corrections.
It is forbidden to use the site for unlawful, fraudulent or abusive purposes or in any way likely to harm the seller, other users, third parties or the proper functioning of the site.
The seller reserves the right to suspend, refuse or cancel orders from users who have breached these Terms and Conditions, provided false data, attempted fraud or misused the site.
Article 8
Right of withdrawal
Pursuant to the legislation applicable to distance contracts, the consumer has the right to withdraw from the contract, without giving any reason, within 14 days from the day on which the consumer, or a third party designated by them other than the carrier, acquires physical possession of the product.
The seller may grant, on a commercial and more favourable basis, a longer period for requesting a return, equal to 30 days from receipt of the product, as indicated on the site. This extension does not in any way limit the 14-day legal right of withdrawal granted to the consumer.
To exercise the right of withdrawal or request a return within any commercial period granted, the user must submit a request through the returns portal available on the site or contact the seller at the e-mail address help@notoriousbrand.it, indicating the order number, the products to be returned and the data needed to identify the purchase.
The product must be returned in the same condition in which it was received: unworn, unwashed, unused, undamaged, complete with tags, labels, accessories and original packaging, where present.
The seller reserves the right to refuse the return or reduce the refund if the returned product is used, damaged, missing essential elements, altered or otherwise handled beyond what is necessary to establish its nature, characteristics and functioning.
Article 9
Return costs borne by the user and returns to China
Except in the case of a defective, incorrect, damaged or non-conforming product, the shipping costs for returning the product are borne entirely by the user.
The user expressly acknowledges that the seller also operates through a model of direct shipping from suppliers, logistics partners or warehouses located abroad, including China. Therefore, in the event of withdrawal or a return due to a change of mind, size exchange, colour exchange, error in choosing the product or any other reason not attributable to the seller, the product may have to be sent back to a return address located outside Italy and/or outside the European Union, including an address in China.
The user is informed, before the purchase and through the acceptance of these Terms and Conditions, that return shipping to China or to another non-EU country may involve higher costs than a normal domestic or European shipment.
These costs may vary depending on the courier chosen by the user, the weight and size of the parcel, the country of destination of the return, the tracking service, any customs procedures and the rates applied by the carrier.
The seller is not responsible for the costs applied by the couriers chosen by the user for the return shipment, nor for any delays, loss, customs holds or failed delivery of the return parcel where the shipment is organised directly by the user.
For this reason, the user is invited to use a tracked shipping service and to keep the shipping receipt until the refund procedure has been completed.
Products returned without a prior return request, without the seller's authorisation or sent to an address other than the one communicated by the seller may not be accepted and will not give the right to a refund.
Article 10
Refund in the event of withdrawal or return
Once the returned product has been received and it has been verified that the conditions for the return are met, the seller will inform the user of the approval or rejection of the refund request.
If approved, the refund will be made using the same payment method used for the purchase, unless otherwise agreed between the parties.
The refund will include the price paid for the returned product and, in the cases provided for by law, any standard delivery costs incurred by the user at the time of purchase. Any additional costs resulting from the choice of a delivery method other than the least expensive standard delivery offered by the seller will not be refunded.
The costs incurred by the user for the return shipment remain the user's responsibility and are not refundable, except where the return is due to a defect, error or non-conformity attributable to the seller.
The seller may withhold the refund until the returned product has been received or until the user has provided proof of having sent it back, whichever is earlier, within the limits permitted by applicable law.
Article 11
Defective, incorrect or non-conforming products
The user is required to examine the product upon delivery and to promptly report any defects, damage, product errors, size errors or non-conformities with respect to the order placed.
The report must be sent to the e-mail address help@notoriousbrand.it, attaching, where possible, the order number, a description of the problem and photographs of the product, the packaging and the shipping label.
Where the product is actually defective, incorrect, damaged or non-conforming for reasons attributable to the seller, the user will be entitled to the remedies provided for by law, including, where applicable, replacement, repair, price reduction or refund.
In such cases, the costs necessary for returning the product may not be charged to the consumer, unless a different remedy is agreed with the user in accordance with applicable law.
Slight colour differences due to the display of the product on different screens, natural measurement tolerances, minimal production variations or elements expressly indicated on the product page do not constitute a defect or non-conformity.
Article 12
Exclusions from the right of withdrawal
The right of withdrawal is excluded in the cases provided for by applicable law, including, by way of example, for products made to measure, personalised or made according to the user's specific requests.
For hygiene or health protection reasons, withdrawal may be excluded for sealed products that are not suitable for return for hygiene reasons or reasons connected with health protection, if they have been unsealed after delivery, where such exclusion is applicable to the specific product category.
Any specific exclusions will be indicated on the relevant product page or communicated to the user before the purchase.
Article 13
Size exchanges, colour exchanges and replacements
A size exchange, colour exchange or model exchange does not constitute an automatic right separate from the right of withdrawal, unless the seller applies a different commercial policy.
If the user wishes to replace a product for reasons of size, colour, model or personal preference, they may request a return according to the procedure indicated and, once the refund has been approved, place a new order.
Return costs for size exchanges, colour exchanges or change of mind remain the user's responsibility, unless the seller makes a different commercial decision.
Article 14
Legal guarantee of conformity
For purchases made by consumers, the legal guarantee of conformity provided for by the legislation in force applies.
The seller is liable to the consumer for any lack of conformity existing at the time of delivery of the product and becoming apparent within the period provided for by law.
In the event of a lack of conformity, the consumer is entitled to the remedies provided for by applicable law, under the conditions and within the limits set out therein.
The legal guarantee does not cover defects resulting from improper use of the product, washing not in accordance with the instructions, normal wear and tear, accidental damage, alterations, unauthorised repairs or use not in accordance with the product's intended purpose.
Article 15
Discount codes, promotions and offers
The seller may offer discount codes, promotions, temporary offers or special commercial conditions.
Promotions are valid within the limits and for the period indicated on the site or in the relevant promotional communication.
Unless otherwise indicated, discount codes cannot be combined with each other, cannot be converted into cash and cannot be applied retroactively to orders already concluded.
The seller reserves the right to modify, suspend or revoke promotions and discount codes in the event of error, abuse, fraudulent use or breach of the promotional conditions.
Article 16
Reviews and user content
The site may allow users to publish reviews, ratings, comments or other content relating to the products purchased.
The user undertakes to publish content that is truthful, relevant, not offensive, not defamatory, not unlawful and not harmful to the rights of third parties.
The seller reserves the right not to publish, to remove or to moderate content that is contrary to the law, to these Terms and Conditions or to the rules of fairness and relevance.
The user remains responsible for the content published and indemnifies the seller against any third-party claims arising from unlawful, inaccurate or harmful content.
Article 17
Intellectual property
All content on the site, including, by way of example, texts, images, photographs, videos, graphics, logos, trademarks, layouts, product descriptions, visual elements, code, software and trade names, belongs to the seller or to the respective owners and is protected by intellectual and industrial property law.
The unauthorised reproduction, copying, distribution, modification, publication, transmission, commercial use or exploitation of the site's content is prohibited, except with the prior written authorisation of the seller or of the holder of the relevant rights.
Article 18
Limitation of liability
The seller cannot be held liable for delays or failures to perform resulting from causes not attributable to its own conduct, such as, by way of example, force majeure events, strikes, logistical blockages, customs problems, courier malfunctions, unavailability of IT services, network interruptions, weather events, measures taken by the authorities or other unforeseeable or unavoidable circumstances.
The seller is not liable for damage resulting from improper use of the products, washing not in accordance with the instructions, inadequate storage, alteration of the product or use other than ordinary use.
Article 19
Processing of personal data
The user's personal data are processed in compliance with the applicable personal data protection legislation, as set out in the Privacy Notice available on the site.
The user is invited to consult the Privacy Notice before using the site or making purchases.
Article 20

The site may contain links to websites, platforms, payment instruments, tracking services or applications managed by third parties.
These links are provided for operational or informational purposes. The seller is not responsible for the content, functioning, contractual conditions or privacy notices of sites and services managed by third parties.
The use of third-party services may be subject to terms and conditions and privacy notices drawn up by the respective providers.
Article 21
Changes to the Terms and Conditions
The seller reserves the right to change these Terms and Conditions at any time, including to adapt them to regulatory changes, technical requirements, site updates or changes to the logistics or commercial model.
Changes will be effective from the time of publication on the site and will apply to orders placed after such publication.
Orders already confirmed will continue to be governed by the Terms and Conditions in force at the time of purchase.
Article 22
Applicable law and competent court
These Terms and Conditions are governed by Italian law.
For any dispute relating to the interpretation, performance or validity of these Terms and Conditions, the court of the place of residence or domicile of the consumer shall have jurisdiction, where located within the territory of the Italian State, in accordance with the applicable mandatory legislation.
In the case of purchases made by parties who do not qualify as consumers, the Court of Padova, shall have exclusive jurisdiction, unless otherwise provided by mandatory law.
Article 23
Communications and complaints
For any communication, request for assistance, complaint or information relating to orders, shipments, returns or refunds, the user may contact the seller at the e-mail address:
help@notoriousbrand.it
The seller undertakes to respond to the user's requests within a reasonable time, consistent with the nature of the request and the technical time needed to carry out any checks with suppliers, couriers or logistics partners.
Article 24
Final provisions
Should one or more clauses of these Terms and Conditions be held to be null, invalid or ineffective, in whole or in part, such nullity, invalidity or ineffectiveness shall not entail the nullity of the remaining clauses, which shall continue to remain valid and effective.
The seller's failure to exercise a right provided for by these Terms and Conditions does not constitute a waiver of that right.
These Terms and Conditions constitute the agreement applicable to purchases made through the site, without prejudice to the mandatory rights granted to the consumer by the legislation in force.
